The incident occurred at Walmart on Twin City Highway, according to authorities.

Investigators said they identified the suspect from a social media video showing a male removing a container of ice cream and eating the product from the container.

The consumer was then observed placing the container back on the shelf and closing the refrigerated door, police said. The charge of Class A Criminal Mischief is a result of the monetary loss incurred by Walmart due to the actions mentioned above.

The Port Arthur News received a video Monday taken from an unnamed man’s Facebook page. Under the video was “Happy national soft ice cream day lmao #viral.”

On Tuesday Port Arthur Police Chief Tim Duriso said authorities learned about it when someone reached out to one of the officers.

The officer was sent to the store and had confirmation of the incident. The young man and his parent met with the officer at Walmart on Twin City Highway, where they brought the receipt, which matched the time of the incident, police said Tuesday.

Duriso said police were waiting to see if the Jefferson County District Attorney’s Office would charge the man.
