NEDERLAND — Nederland police said they will not charge the man who shot his former employee in the shoulder Friday, but the evidence will go to the district attorney, per Texas law.

According to Nederland Police Chief Gary Porter, Deshawn Willis, 37, of Port Arthur, arrived at A-1 Box and Tank Wash around 5:30 p.m. Friday to pick up a bonus check. When business owner James Rucker, 60, of Nederland, informed Willis his check was not ready, yet, the two got into an altercation, which resulted in Rucker shooting Willis in the shoulder with a handgun.

Porter said Willis drove himself to a medical center before he was transferred to Christus St. Elizabeth Hospital with what police believe is a non-life-threatening injury.

The district attorney will view the evidence to decide if he will present the case before a grand jury, but has the right to not pursue a case.

A-1 Box and Tank Wash is an industrial-truck cleaning business located at 3077 N. Highway 69 in Nederland.

Friday’s shooting marks the second in the city during the last two months. In late May, Jonathan Loya was charged with the murder of Joshua Caleb Miller. Loya turned himself in to police the following day. Police are still searching for two other male suspects involved in the murder, which took place at Briarcliff Apartments on Twin City Highway.

Porter said police are still waiting for results of forensic testing.
