Officer involved shooting case now at DA’s office

A case involving a Port Arthur police officer that shot and killed a man carrying a weapon is now at the Jefferson County District’s Attorney office.

A DA’s office spokesperson said the case may be presented to a grand jury within the next three to four weeks.

The shooting happened around 4:20 p.m. Dec. 28 in the 1600 block of Kansas when an officer tried to stop and detain a man, later identified by his family as Shayne Lyons, 35, who was walking in the roadway “carrying a large weapon,” according to the initial press release from the police department. The weapon, as reported by his family members, was a machete.

The state Legislature made open carry of knives with blades longer than 5.5 inches — including spears, daggers and machetes — legal in 2017.

The officer got out of his patrol car and asked the man to drop the weapon and he did not comply as he continued towards him. The officer feared for his life and fired several rounds from his service revolver, striking the man.

Emergency medical services were called but the man died from his injuries.

During a press conference a few days later, PAPD Chief Tim Duriso and Jefferson County District Attorney Bob Wortham gave little information about the incident except Wortham who said Lyons was carrying a pack of cigarettes that tested positive for PCP.

The DA’s office and the Texas Rangers are investigating.

Lyons’ family has stated they want answers as to why their loved one was shot.
